The CBI has booked 31 people based in Kerala, including 18 Navy personnel, for allegedly claiming income tax refunds worth over Rs 44 lakh by making false claims of various deductions which were not included in Form16, officials said on Wednesday.

The CBI has booked personnel of Navy and police, and executives of two private companies — an IT major and a life insurance provider — for allegedly using services of agents to make the fake claims, they said.

The central probe agency has alleged that the agents were charging 10 per cent of the Income Tax refund as fee, they said. The CBI action came on a complaint from the principal chief income tax commissioner of Kerala, who alleged that a total of 51 people had made the false claims.

“Out of these 51 assesses, 20 individual assesses, who had falsely claimed and received refund of income tax, repaid the refunded amount totaling Rs 24.62 lakh to the Income Tax Department, after a notice was issued to them by the IT Department, admitting that they had committed mistake in claiming the income tax refund,” the FIR alleged.

The CBI has alleged that the remaining 31 people booked in the FIR have yet not returned the falsely claimed income tax refund totaling Rs 44.07 lakh to the income tax department.

The letter ibid raises the issue of fraudulent claims of refund on IT Returns (ITR) filed by
Govt emoloyees incl Armed Forces pers.
On analysis of IT refunds issued by IT Dept in the last two yrs in r/o taxpayers of J&K, it has been noticed by their office that large No of tax payers have claimed excessive deductions under various Secs of the IT Act without actually being eligible for such deductions.
A No of Armed Forces pers have also been roported to have indulged in such malpractices. IT Dept views such practices as breach of trust by the taxpayers.
As por IT Dept (JK), 25,675 Offrs/JCOs/OR have claimed 100% of TDS as refunds and thus, effectively paid no IT. It has been cautioned by IT Deptt that such cases of bogus refunds will lead to scrutiny and assessment of their cases resulting in recoveries besides levying of ponalty under Sec 270A of IT, which is 200% of the tax
in view of the above, all Def pers may be advised to claim correct refund with sp docu after secure Jogin Into IT Dept website or contact registered tax consultants for filing ITR and claim genuine refunds. Offrs/JCOs/OR may also be sensitised on the fwg:
As per Sec 139 (8A) of IT Act, in case bogus refunds have been claimed by tax payers in the FY 202021 and 202122, they can submit updated and correct ITR (ITRU) on or before 31 Mar 2024 with penalty which is 50% of ediat plus intorest for FY 202021 and 26% for FY 2021;22.
