Hey guys, it’s Cesar and welcome to another Tips for Landlords & Property Managers video. Today’s topic will cover the 3 Day Notice to Cure or Quit. Remember, you can find this free form along with many other free California eviction forms on our website by clicking on the link in the description.

This notice is served to a tenant that has violated any of the agreed upon terms in a lease other than not paying rent. Other names for this notice include 3 Day Notice to Perform Covenant or Quit or 3 Day Notice to Perform or Quit.

This notice is typically served to a tenant that has, as mentioned before, violated a clause in the lease and the issue can be easily resolved. Some examples include:
Unauthorized pet or person has moved in without letting the landlord know.
Made unauthorized renovations to the rental.
Tenant makes no attempt to keep the rental clean.
Noise complaints.

So what must your 3 day notice to cure or quit say? As you probably already know, you can find this notice and many more on our free notice section of our website. Here are some points the notice should cover:
Letter must be in writing.
Letter must have the full names of all tenants residing on the property.
Must include the full address of the rental.
You must write a statement on what the tenant did to violate the lease or agreement.
Include the clause number or section number of the lease along with the verbiage of the clause that was violated.
Include in writing that the tenant has the opportunity to amend the violation within the 3 days or move out.
Must be dated and signed by the landlord or an authorized person to serve the notice.
Lastly, this notice must include dates, times and witnesses of the violations mentioned.

Remember to print two copies, serve the tenant either by personal service, sub service or posting and mailing.

Keep in mind that as of September 1st, 2019, weekends and holidays no longer count within the 3 days of the notice. In other words, you count 3 business days until the notice expires. This law also applies to the answer period of the summons and complaint during the eviction process. Let’s take a look at a couple of examples.

If you serve the notice on either Monday or Tuesday, you have nothing to worry about as you can count the days as is. If, however, you serve your notice on Wednesday, Thursday would be day 1, Friday would be day 2 and we would have to wait until Monday to count day 3.

Another example: you serve the notice on Friday. Day 1 would be Monday, day 2 would be Tuesday and day three would be Wednesday.
