3 Day Notice Update - How to Count the Days

There were changes made in September 2019 to how you count the days during a California eviction case. Find out what you need to know by watching this video.

Hey! It’s Cesar with another Tip for landlords and property managers. This is more of a quick update to an existing video. I want to quickly explain the recent update to how you count the 3 days in notices such as 3 day notice to pay or quit and 3 day notice to cure or quit as stated in assembly bill number 2343.
Before, you could serve a 3 day notice on a Friday and it would expire on Monday. This bill now amends section 1161 of the Code of Civil Procedures to read, and I quote “This bill would change the notice period to exclude judicial holidays, including Saturday and Sunday.”
So now when you serve a 3 day notice to pay or quit on a Friday, this notice would not expire until Wednesday. We recommend serving your notices either on Mondays or Tuesdays.
Remember that the 5 days the tenant has to respond to a summons and complaint also does NOT include judicial holidays, Saturdays or Sundays.
