There is a turning point where harassment becomes unlawful. This occurs when an employer says you must endure the behaviors and environment to stay employed. This can also occur when the conduct is pervasive enough to create an intimidating, hostile, or abusive work environment.

Most people leave their job because of a bad boss that doesn’t appreciate them. This is especially true if you have a bad boss that is yelling at you and showing verbal aggression.

If an employee is aggressive with you or a peer, this is a clear sign that your work environment is hostile. If there is lots of yelling or shouting going on from cubicle to cubicle, then there is a good chance that tension is high, putting everyone on edge.

Verbal aggression isn’t just yelling at someone without a valid reason. It can also include mean remarks, spiteful comments, or other abusive comments.

According to the EEOC, sexual harassment includes unwelcome sexual advances, requests for sexual favors, and any harassment of a sexual nature. Harassment can also include offensive, nonsexual, remarks about a person’s sex.

Inappropriate comments about your physique, your makeup, or your clothing all count as verbal sexual harassment. If someone keeps asking you out on dates even after you have communicated that you are not interested, then that is sexual harassment as well. It includes namecalling, whether to you privately or in front of your coworkers.

Nonverbal sexual harassment can include inappropriate touching, especially after you have told the offender to stop or that their behavior makes you uncomfortable. It can also include leaving items on your desk, like an inappropriate note or picture.

MerriamWebster defines discrimination as “the practice of unfairly treating a person or group of people differently from other people or groups of people.” It makes a distinction between discrimination and racial/sexual/religious discrimination. The definition of the latter is discrimination based on race, sex, or religion.

Discrimination can manifest itself in many ways. It can be comments made to your face or behind your back. It could be that you get paid less than your coworkers because you are part of a minority group. Discrimination could also occur if you are not promoted on time compared to your peers because of your protected characteristics.

Offensive jokes or racial slurs can fall under verbal sexual harassment and discrimination. No matter the situation, there are certain things you cannot joke about in a professional environment.

Offensive jokes can include those related to weight, eating disorders, or physical appearance. Topics such as sex, religion, race, sexual orientation, mental health disorders, or any type of disability should never be the subject of humor in the workplace.
