Did you know intentional theft of wages or tips by employers is punishable as grand theft, effective on January 1, 2022? Our expert employment lawyer and partner, Marie Davis, Esq, explained California's AB 1003 Wage Theft labor law during a recent interview with Fun with HR radio program.

AB 1003 makes it a felony if an employer intentionally fails to pay wages in an amount greater than $950 to one employee, or $2,350 in the aggregate to two or more employees, within a 12month period. The bill would specifically authorize wages, tips/gratuities, benefits, or other compensation that are the subject of a prosecution under these provisions to be recovered as restitution in accordance with existing provisions of law.
Under AB 1003, Independent contractors are also covered for purposes of this new criminal offense.

Marie also emphasized the importance of paying employees overtime, as well as auditing payroll records since the "burden of proof" is on the employers in California.
