Regarding Adjournment

I’m not a big fan of it. Judges don’t like it. It’s better to avoid seeking adjournments.

However, there are situations sometimes when one may have to take a short date.

The judges will not be happy. What do you do?

Let me share two incidents:

Incident 1
A young advocate appeared in a case which was opposed by senior advocate. He wanted an adjournment. But, instead of going first and seeking adjournment immediately, he let the senior advocate start. The senior advocate just went on with the matter. When it was the young advocate’s turn to speak, he sought an adjournment. Perhaps his senior was not available. The judges became angry and blasted him.

Incident 2
Advocate from one side wanted adjournment. But, he waited for the opposing advocate to come. Once the opposing advocate came, he smartly asked whether he wanted to go on with the matter or seek an adjournment. The other side wanted an adjournment. He let him ask the judge. This time the judge got angry at opposing advocate.

Tip: Don’t ask for adjournments. Be prepared with the matter and argue.

However, in case you need an adjournment, just politely ask the other side first. You must respect the opposing advocate and the judge’s time.

PS There may be situations where the opposing side may request you for an adjournment. I have seen very senior advocates accommodating and not making a scene. Unless the matter is pressing, and a single adjournment won’t hurt the client’s case, once in a while agreeing to adjournment won’t anger the judge or the client.
