Adoption is the process of legally and permanently transferring parental rights and responsibilities from the biological parents to adoptive parents. In India, adoption is governed by the Juvenile Justice (Care and Protection of Children) Act, 2015 (JJ Act), and the Guidelines Governing Adoption of Children, 2015.

Under the JJ Act, any child who has been declared legally free for adoption by the Child Welfare Committee (CWC) can be adopted. The CWC can declare a child legally free for adoption if the child is an orphan, abandoned, or surrendered by the biological parents.

The adoption process in India involves the following steps:

Registration: The first step in adopting a child is to register with a Specialized Adoption Agency (SAA) or a recognized adoption agency.

Home Study: Once the registration is complete, a social worker from the agency will conduct a home study to assess the suitability of the prospective adoptive parents.

Child Referral: After the home study is completed, the adoption agency will provide a child referral. The prospective adoptive parents can choose to accept or reject the referral.

Acceptance and Counseling: If the referral is accepted, the prospective adoptive parents will undergo counseling to help them prepare for adoption.

Court Proceedings: Once the counseling is complete, the adoption agency will file a petition for adoption in court. The court will then conduct a hearing and if satisfied, will grant an adoption order.

Followup: After the adoption is finalized, the adoption agency will conduct followup visits to ensure that the child is being cared for properly.

It is important to note that adoption in India is a legal and lengthy process, and it is important to work with a recognized adoption agency to ensure that all legal requirements are met.
