Reasons for Asylum Delays:
Global Displacement Crisis: The world is grappling with unprecedented levels of displacement, leading to a surge in asylum claims worldwide. Canada, like many other countries, has witnessed a significant rise in asylum applications.
Pressure on Shelter Systems: The influx of asylum seekers has put immense strain on Canada’s shelter systems. As winter approaches, the urgency to address this issue becomes even more pronounced1.
Administrative Challenges: The IRB, as Canada’s largest independent administrative tribunal, handles approximately 50,000 decisions annually related to refugee protection and immigration matters. However, the sheer volume of cases poses administrative challenges, leading to delays.
Public vs. Private Proceedings: Proceedings before the IRB vary in terms of privacy. While proceedings before the Immigration Division and the Immigration Appeal Division are generally held in public (except for refugee claimants), the Refugee Protection Division and the Refugee Appeal Division operate in private. Balancing transparency with privacy rights is crucial2.
Pending Cases at IRB (February 2024):
The IRB continues to grapple with a backlog of pending cases. Despite efforts to streamline processes, the sheer number of claims necessitates ongoing attention.
A temporary “topup” investment of $87 million over two years has been allocated to address the growing pressures on the asylum system and position the IRB for success in a postpandemic environment3.
The IRB remains committed to ensuring fair and efficient proceedings while safeguarding the rights of asylum seekers.
