Can a Notary Accept an Expired ID?

Being presented with an expired ID is not uncommon. Depending on your state’s Notary laws, you may be able to accept an expired ID. If you cannot, there are options. For more information, visit the Notary Bulletin: https://bit.ly/3zk8UOq

1. Know your state’s guidelines.A number of states permit Notaries to accept expired ID. There is usually a time limit on how long the ID may be expired. When reviewing your state's requirements, pay attention to the difference between date of issue and date of expiration.

2. States that do not provide guidance. Less than half the states in the United States provide specific guidelines about expired ID. For Notaries in these sates, the NNA recommends as a professional standard of practice that you make it a policy not to accept expired IDs.

3. Know Your Options.If the ID presented is not acceptable in your state, you may have other options including the acceptance of a valid US Passport or one to two credible witnesses, depending on your state.
