No Child Custody For Fathers | New Family Law on Child Custody | Legal Gurukul

In this child custody case, the father sought custody of minor daughter child on grounds that mother had multiple affairs. The court however held that in child custody matter, welfare of child is the most important. Court in this child custody judgement also held that allegations of adultery of mother are not proved and even if it is proved that mother is in adultery then also child custody to mother cannot be denied on basis of adultery. This a landmark judgement in child custody case in India.
