In this short video, Washington State Criminal Defense Attorney Ryan Witt explains how Domestic Violence, or "D.V." isn't actually a criminal charge, rather it is a "special allegation" to an underlying criminal charge. This will be very important to you if you have a domestic violence "charge" in Washington State. Usually the underlying charge is that of Assault or Malicious Mischief, but it can literally be anything.
The domestic violence special allegation is serious business when added onto a criminal charge. It allows stricter enforcement for the Court when it comes to enforcement, and the restrictions are greater. Also, it limits the ways in which your attorney can resolve your case for you.
If you have an Assault case with a DV Tag in Washington State, we are here to help.
