North Carolina General Statute 5020 defines marital property as any property acquired by the spouse during their marriage prior to their date of separation and presently owned by them except for property that was received by one of the spouses as an inheritance or gift from a third party. Marital property can include homes, pets, stocks, cars, etc. Marital debt is also included in equitable distribution cases. Either spouse can attempt to ask for more than 50% of the marital assets as well, which is why having an attorney is so vital. Jaime recommends that you always keep a cool head and not let anger cloud your judgement when it comes to the division of your marital property so that you can get the best outcome possible and also recommends that you rely on a licensed counselor or psychologist to discuss the powerful emotions that occur during a divorce, as opposed to speaking only to an attorney, as this can often be a less expensive route to take.
