Define 'foreign service'. Give in broad outline the main nditions under which a Government servant can be transferred t h service.

Ans. Foreign service means service in which a Government servan ves his pay with the sanction of Government, from any source other the Consolidated Fund of India or the Consolidated Fund of a State or
Consolidated Fund of Union Territory.

The following are the main conditions regulating the transfer of government servant to foreign service:

(1) The Government servant should be willing. Exception: Transfer to bodies owned or controlled by Government. FR 110 (a). 2) It should be sanctioned by the Competent Authority FR 110(b)
3) Duties in foreign service should be such as are required to be performed by the Government servant FR 111 (a).
4) Terms should not be so excessive as to make foreign service more attractive than Government Service.

(5) If foreign service involves duties and responsibilities of greater importance, pay should be fixed with reference to such duties and the status of the official.

(6) The intention to grant any concession of pecuniary value must be specified in the terms of foreign service.
7) Joining time both ways and pay during the period should be settled
beforehand. FR 114.

(8) T.A. both ways is payable by the foreign employer and should be
settled beforehand.SR 307

(9) Medical facilities available in Government service should be extended while under foreign service also.
10) No gratuity or pension should be received by the Government servant from the foreign employer without the sanction of the Government.FR 121.

(11) HRA should be paid at the rates admissible under the rules of the Borrowing Authority; but the Borrowing Authority may at its discretion allow the allowance under the rules of the Central Government.
(12) The cost of leave travel concession has to be met by the foreign employer if provision for its admissibility has been incorporated in the orders placing the Government servant on foreign service. (13) The incumbent will be entitled to claim CEA Scheme in respect of his children from the foreign employer.
(14) The whole expenditure in respect of any compensatory allowance for the periods of leave in or at the end of foreign service shall be borne by the foreign employer.

(15) Payment of the following contributions at prescribed rates must be 'settled:
(a) Contribution towards pension or contributory provident fund.
b) Contribution towards leave salary.
