On today's video, we'll cover California Small Claims Court.

1st step: In California, you're required to demand payment prior to filing a lawsuit. This can be in writing, or verbal, however, it's better to have it in writing just in case the other party says you've never demanded payment. 2nd Step: You have to prepare your Lawsuit. You're going to use the form "SC100 Plaintiff Claim and Order." You can Google it and find it on the Court's website. https://selfhelp.courts.ca.gov/jccfo...

3rd Step: You're going to file the Lawsuit with the Court.
Each court has a different process. Go to your local court website to understand how you can file your lawsuit with the court.

4th Step: You have to notify the other party that you have sued them. This is called "Serving." Like in the movies, when you see them say "you have been served." You CANNOT serve your own Lawsuit. Someone other than you a neutral third party has to serve your lawsuit. For example: you can have a "process server", a friend or family member, or a sheriff serve.

5th Step: Once you have served the other party, the person who did the serving has to fill out a form that they have served the other party and how. That form is called the "SC104 Proof of Service" form.

Step 6: You have to prepare for the hearing. Do not show up to court unprepared. You want to have your contracts, receipts, text messages, everything you have that proves your case organized and ready to go in a judge friendly evidence packet.

Finally, Make sure you show up to Court. You don't know how many people fail to ACTUALLY show up to the hearing and present to the judge. Do not be late!
