Sometimes the most important question I get asked is, "When can I kick this Tenant out?" Most Landlords are dumbfounded by the fact that they simply cannot enter their own property and verbally demand that the Tenant (who has failed to pay rent and/or violated some other provision of the lease) to simply leave.
"How do Tenants have so many rights?" I also get asked that a lot. However, I tend to tell Landlords that the same courts that we use to enforce our Leases are the ones that hold us to the letter of the laws of our great state. We are bound to follow the rules of the Texas Property Code in much the same way we expect our Tenants to follow the rules of the Lease. This is never truer than when we can actually recover use of property, and there is a clear and definite timeline that a Landlord must follow if the Tenant does not leave voluntarily.
