In his keynote presentation at 2022 MD Notary Public Day Conference hosted by Trusted Agent Services Group LLC, NNA’s VP of Government Affairs Bill Anderson explains how Notaries can lean on standards of professional practice when state Notary laws are vague.

Standards of practice, or practice standards for short, are the minimum acceptable principles, practices, and conduct expected for a Notary Public. These standards are widely recognized to be effective in ensuring the integrity, reliability, and security of notarial acts.

The purpose of having Notary standards of practice in place is to:

1. Provide rules for expected Notary conduct
2. Make notarizations more trustworthy

State laws and standards of professional practice overlap in some situations, but there are standards outside of statute. One example of a standard of Notary practice outside of Notary law says that Notaries should not notarize a document containing blank spaces because someone could enter information there that wasn’t there when the Notary had notarized the document. This standard prevents fraud.

You can find all the standards of professional practice in the Notary Public Code of Professional Responsibility. Serving as your field guide, it provides guidance for Notaries performing traditional or technologybased notarial acts.

1. Standards written in law (01:32)
2. Standards not written in law (03:06)
3. Where to find standards not written in law (06:02)
4. Standard that guides how Notaries should behave (07:01)
5. Standard that makes notarizations more trustworthy (14:56)
