Jones v. Alfred H. Mayer Co. | 392 U.S. 409 (1968)

For a full century after the adoption of the Thirteenth, Fourteenth, and Fifteenth Amendments, progress in civil rights seemed to come at a snail’s pace. Congress was stingy with new civil rights legislation, and the courts overruled much of what Congress did pass. But by the late 1950s and into the 1960s, courts had begun to expand the reach of civil rights laws barring racial discrimination. One big step was the 1968 decision in Jones versus Alfred H. Mayer Company.

The Alfred H. Mayer Company, a residential developer that we’ll call the company, refused to sell a home in St. Louis, Missouri, to Joseph Lee Jones because Jones was African American. Jones sued the company in federal district court, asserting that by refusing to sell the property to Jones because of his race, the company violated 42 United States Code section 1982, part of the Civil Rights Act of 1866. The district court dismissed Jones’s lawsuit, and the circuit court of appeals affirmed. Both courts claimed that section 1982 applied only to state governmental action, not private discrimination. The United States Supreme Court then granted cert.
