All workers, regardless of immigration status, have rights to fair pay and a healthy and safe workplace free of harassment and discrimination. Even if you are undocumented, your employer cannot deny you pay that you have earned or harass you or retaliate against you for asserting your legal rights. Unfortunately, employers often try to take advantage of workers without legal status by threatening workers with immigration consequences if they assert their legal rights. In these cases, workers may be eligible for special immigration visas that provide relief to workers in abusive workplace situations.
