Matthew Talbot discusses about a Conservatorship and Trust Trial in California Probate Court

Hello, I am Elizabeth Talbot and I am joined by Matthew Talbot from the Talbot Law Group in Walnut Creek, California. Today, we would like to discuss Matthew's recent trial experiences, specifically a case that involved both a conservatorship trial and a trust trial. Although the trust trial was ultimately resolved due to the successful outcome of the conservatorship trial, we will focus on the conservatorship trial in this video. Matthew will provide some insight into the details of the case.

Over the past eight months, we have been involved in numerous trials, including the fiveday long conservatorship trial we are discussing today. This trial was conducted entirely over Zoom and involved a case where a mother had been functionally kidnapped to rural California by one of her children. At the Talbot Law Group, we frequently handle kidnapping cases, and it is not uncommon for family members to be involved. Typically, kidnappings are not committed by strangers but rather by family members, where the mother is often used as a pawn in a power struggle. In this instance, we aimed to return the mother to her home or a facility where she could receive proper care. Additionally, the opposing party had taken the mother to an attorney in another part of California to change the trust and exclude one of the three children. Therefore, we needed to deal with both the conservatorship trial and the trust trial.

During the conservatorship trial, we called on multiple doctors to testify, including an expert witness who provided analysis on the other doctors' statements. Several family members, including the opposing party, also testified. We successfully achieved our goal and were able to get the conservatorship set up, allowing the mother to move back to the Bay Area and receive excellent care. The court even issued a fee order, which resulted in our client being paid a sixdigit sum in attorney's fees and costs.

Due to the success of the conservatorship trial, we were able to use it to leverage a settlement in the trust matter. Although the opposing party was not cooperative, we were eventually able to settle the trust matter with a global arrangement. Our primary focus is always to obtain a global agreement for all aspects of the case, whether it is a trust, probate, or conservatorship. We believe that settling all issues leads to a better outcome for everyone involved.

In the end, our client received a significant portion of the trust, and the mother was returned to the Bay Area, where all of her family members could visit her.
