There is a dramatic difference between an uncontested estate settlement and a contested estate settlement.

If you suspect that your Will may be contested (or even if you don't suspect it), there are at least seven things that you can do when putting your estate legal program in order to reduce the likelihood of a contested estate settlement:

(1) Ensure the validity requirements are met;
(2) Make it easy to prove your capacity;
(3) Remove the appearance of undue influence;
(4) Make certain the language in the will is clear;
(5) Insert a NoContest Clause;
(6) Communicate the "Why" you are doing what you are doing; and
(7) Make certain the right people have access to your original testament.
