In July 2023, the USCIS introduced a new Form I9, along with a new procedure for remotely verifying I9 documents. As of August 1, 2023, employers who participate in EVerify and are in “good standing” have the option of examining Form I9 documents during a video conference instead of in person.

The remote verification procedure requires a qualified employer to do all of the following within three business days of an employee’s start date:
Examine all Form I9 documents (including the front and back of any doublesided documents) to ensure that the documentation “reasonably appears to be genuine.”
Conduct a live video interaction with the employee to verify that the documentation “reasonably appears to be genuine and related to the individual.”
Check a box on Form I9 indicating that an alternative procedure was used to examine I9 documentation
Retain clear and legible copies of documentation
