Should a landlord pay a tenant to leave? | Cash For Keys

As a landlord I often hear folks recommend paying a tenant to leave a property to avoid an eviction. Amongst the real estate investor community this is known as cash for keys.

In my opinion cash for keys is a necessary evil but not something we offer very often at all.

When you pay a tenant to leave a property you are plain/simple rewarding bad behavior. I am NOT saying that people who fall behind on their rent are in the wrong. They are only in the wrong when they don't vacate the property and insist on staying until evicted.

As a rental property owner you are doing every other landlord in your market a disservice by giving them a free ride. When they go to rent for your friend at the local Reia their background check will come back with no evictions.

There are a few instances in which we will offer a cash for keys agreement.

1) If we are helping someone sell a property that they need vacant and they can't or don't want to go through the eviction process.

2) If we think an occupant has a claim at adverse possession, is a family member, or potential heir and we're trying to keep things neat/clean.

One thing that should be noted is that in Indiana it takes about a month to get a tenant out. This is one of the perks of doing business in the state. If you are in a market that takes 2, 3, 4, 5, 6+ months I don't fault you for using this option at all.
