South Carolina Sex Offender Registry Removal

In this episode of Level Up Law where we delve into the process of getting removed from the sex offender registry in South Carolina. Learn more about the sex offender registry and the situations where an individual can be removed from the registry. The South Carolina Supreme Court established in Powell v. Keel that SC's lifetime registration requirement was unconstitutional because it did not provide for a process of judicial review to determine whether the individual was at risk of reoffending. This led to the creation of a process for those listed on the registry to seek removal, as is standard in many states throughout the United States.

Currently, sex offenders are classified under a 3tier system, each with their own removal process. Tier1 and Tier2 have similar processes, while Tier3, the most severe level, has the most difficult removal process.
