FYI – the auto insurance company wants to pay you as little as they can and you want to recover as much as you can. So how can you increase the amount of your recovery?

2. Second – the insurance co is going to try and get you to settle quickly. Don’t do it. Do not accept that first offer.

3. Third File a claim asap – with both insurance companies – yes your insurance company too.

4. Fourth – get Medical treatment right away.
5. Fifth – do not stop going to the doctor until you are discharged from care and do not have a ‘gap in treatment’.

6. Sixth Report all medical injuries to anyone who treats you. If its not documented in the records – it doesn’t exist.

7. Seventh Be prepared for insurance companies to try and diminish your claim by arguing that your injuries are preexisting.

8. Eighth – you can overcome the preexisting injury argument by arguing that your preexisting injuries were aggravated or exacerbated by the accident.

9. Nine Keep everything: receipts, bottles of meds, shoes you were wearing if slip and fall, clothes etc.

10. Ten Be careful what you post and what you do – they’re watching.

11. Eleven, focus on future damages and permanency. You can recover for future medical expenses lost wages and permanent injuries.

12. Twelve Exhaust all the benefits available to you. You may be able to go after your own auto insurance for uninsured or underinsured motorist coverage and you may have other coverage like medpay to use.

13. Thirteen take Photographs of everything. The accident scene, your injuries, all property damage. I’ve had cases where photos were the single most important factor in my client increasing their settlement.

14. Fourteen – regarding taking photos of the property damage, something you might not have thought about is the concept of Severity of impact.

15. Fifteen – create a Journal to document what you’re going through.

16. Sixteen Document everything – do not trust the insurance company. So don’t just leave voicemails. Make sure everything is in writing.

17. Seventeen Be patient. This is a long process. Let your attorney build your case from the bottom up.

18. Eighteen Research the timelines involved in your case and do not delay.

19. Finally #19, File a lawsuit – insurance companies are not bound by law to offer great settlements. If you’re not happy and your attorney thinks you can get more money, file a lawsuit.
