Truancy and IEP/504 Protected Kids: What About When the Kid is Not Wanting to Go to School?

School avoidance is a real problem and a common one, depending on the disability and how it manifests. In most of these legitimate instances, the student will resist and struggle with the parent to get ready for the school day and, in a lot of those cases, the kid is bigger than the parent. When this is the case there is something that has happened or ongoing within the school environment that is triggering this refusal response.

The school has 100% of the duty to provide a FAPE and that requires that the student access the school program. Transportation is a right under 504 and special education for that exact reason.... so that the student has the capability to come to school to access the developed program and services. A child's behavioral responses that is connected to the school environment is not solely the parent's responsibility and very well could be outside their ability to address or expertise to remedy. This becomes an IEP team consideration or 504 plan consideration.... it is not a police or court or DHR/CPS matter and this is the lazy ignorant and aggressive ways schools typically handle these problems.
