Visit Visa Canada: Restricted Entry at the Port of Entry
Are you planning to visit Canada? Understanding the entry process and restrictions is crucial. In this video, we’ll delve into what happens when you arrive at the port of entry (POE) and encounter a Canada Border Services Agency (CBSA) officer.
The Examination Process:
At the POE, the first person you’ll encounter is a Border Services Officer (BSO) at the Primary Inspection Line (PIL).
The BSO has two options:
Authorize Entry: If everything checks out, they’ll allow you to enter Canada.
Refer to Secondary: If additional examination is needed, you’ll be directed to secondary inspection.
Secondary inspection involves more thorough checks, including bag searches, background verifications, and even phone inspections.
When Does the Examination End?
According to Regulation 37 of the Immigration and Refugee Protection Regulations (IRPR), the examination ends when:
A final determination is made that you have the right to enter Canada or are authorized to do so, and you leave the POE.
If you’re in transit, you depart Canada, and an officer verifies your departure.
A removal order is issued by a Minister’s Delegate.
The CBSA refers an inadmissible person to an admissibility hearing at the Immigration and Refugee Board’s Immigration Division1.
Visitor Visa Duration:
Most visitors can stay in Canada for up to 6 months.
The border services officer may allow you to stay for less or more than 6 months based on your circumstances.
They’ll stamp your passport with the date you need to leave by.
You might also receive a visitor record indicating your departure date2.
Refusal at the Port of Entry:
If the officer believes your entry would be contrary to the Immigration and Refugee Protection Act (IRPA) or its Regulations, they may refuse entry.
In such cases, they prepare a report (A44 (1)) detailing the reasons for refusal3.
