Genuine Student Requirement for Student Visas

Recently GTE Genuine Temporary Entrant, a requirement for student visas has been replaced by a Genuine Student requirement starting from 23rd of March 2024.

The major difference between the GTE and the GS is that GTE students had to prove that they would go back to their home country after completing their studies, which is not the case anymore.

Previously, GTE was a statement of 300 word limit that was to be included in the application form, where GS is a set of questions in the application form itself with a word limit of 150 words each which provides more space to the students to explain themselves.

GS questions are very similar to what students used to include in their duty statements.

For example, first, applicants current circumstances, including their ties to their family and community back home.

Second, employment circumstances. If they have been working and their financial circumstances.

Third, there are potential circumstances in Australia, for example, their knowledge of living in Australia, their goals and the education provider and the research that they have done in relation to all these.

Fourth, why the student wish to study that particular course in Australia with this particular education provider?

Fifth, how completing the course will benefit the student in future.

The applications made onshore will be scrutinized and the students will be asked further questions about their previous studies in Australia and whether they complied with their previous visa conditions or not.

If they were holding any of the visas, they will be asked why they did not apply for the student visa at the first place.

They have also included a section in the application form about the other relevant information which provides an option to the students to include more information if they wish to.

The student declaration in the application form has also been updated and now includes that students will inform the department about any changes in their circumstances, which includes their contact details or changes in the family unit.

The other major clause included in the Declaration is that if the visa ceases and the student do not hold another visa to remain in Australia, they will be expected to leave Australia and they might be subject to removal.

These are some of the major changes in terms of GS.

Student visa applications lodged before this date that is before 23rd of March 2024 will be assessed on the basis of GTE.

But we are experiencing that even for the students who launch their applications before this date and whose applications are still in processing, are being contacted by the universities or colleges and are being asked to answer the GS questions so that the universities and colleges can issue a revised offer letter or a revised COE.
