One of the WORST mistakes we are seeing in small claims court when suing over your security deposit is that many people are suing the property management company and not their landlord.

Your landlord is the one who is ultimately responsible, AKA liable, for your security deposit. Your landlord HIRES the property management company to manage their rental property. Ultimately, it’s your landlord who’s holding on to your security deposit.

So how do you know who your landlord is?

Look at your lease agreement, normally on the first page of your lease agreement, you will see your landlord listed there. You will also likely see who the property management company is. If your lease is not clear on who your landlord is, you can also try running a property tax record search in the county where the rented unit is located in.
