Will is a wish of a person to bequeath his assets to his close friends and family. A Will is an important document which decides that how the assets of the deceased will be divided after the death of the person. A Will is made where a person decides to cut the line of succession and distribute his assets unlike the laws of succession. Example: A Father with two sons and two daughters ; if wishes to give the assets to one son and one daughter; that is when Will would come into picture.
A Will can be registered or unregistered. The registration only has evidentiary value. The Will must have two attesting witnesses; from whom at least one can step into the witness box if required.
Most of the times persons assume that the inheritance would happen as per their wish or the family will enter into settlement etc.
Why leave a dispute for later stages and why put relationships go through the grill for your property. If a property belongs to you; let it be divided as per your wishes. Let the wish be documented in a legal manner.
A Will can be made in any country but should specifically mention your assets in India; how you wish to bequeath them and let it attested by two persons who are not going to benefit from the Will. These two persons should be capable of coming to the court if required.
