What is a work permit?

A work permit is a document that entitles a foreigner to work legally in Poland, provided that the foreigner has a basis of residence enabling them to perform work in accordance with the regulations.

Types of Work Permit

There are 5 types of Work permits in Poland :

TYPE A obtained in the case of a foreigner who will perform work in Poland on the basis of an agreement with an entity whose seat or place of residence, or a branch, plant or other form of organized activity is located in Poland.

TYPE B is obtained in the case of a foreigner who will perform work consisting in performing a function in the management board of a legal person entered in the register of entrepreneurs or being a capital company in organization, or in connection with running the affairs of a limited partnership or limited jointstock partnership as a general partner, or in connection with granting them a procuration for a total period exceeding 6 months in consecutive 12 months.

TYPE C obtained in the case of a foreigner who will perform work for a foreign employer and will be posted to the territory of Poland for a period of more than 30 days in a calendar year to a branch or plant of a foreign entity or a related entity.

TYPE D obtained in the case of a foreigner who will perform work for a foreign employer without a branch, establishment, or other form of organized activity on the territory of Poland and will be posted to the territory of Poland in order to provide a temporary and occasional service (export service).

TYPE E obtained for a foreigner who will perform work for a foreign employer and is posted to the territory of Poland for a period of more than 30 days within consecutive 6 months for a purpose other than for the type B, C, D permits.

Information that should be included in a Work Permit

▪Identifier in the central system; document number and code
▪Date of issue
AmeName of the unit that issued the work permit
▪Case number
▪Type of permit,
Legal basis of Decision,
▪ Surname and forename (s) / name of company, address of the company, telephone / fax / e mail

Information about foreigner who will be performing the work:
▪ Name and surname,
▪ Nationality,
AteDate of the birth,
ObJob position, type of work performed,
▪Type of employment contract,
Working time / weekly hours of work,
▪Gross monthly salary –in polish currency,
PeriodThe period of time by which the work permit is valid,

In addition, at the bottom left corner of the page should be the official stamp and on the right side the stamp and signature of the competent issuing authority.

Who applies for a work permit?

It is your employer’s duty to start the procedure. The authority responsible for issuing work permits is, as in the case of visas, the voivode’s office (There are 16 offices in different regions). Your employer needs to deliver all necessary documents, which differ for each type of permit. You will find them listed on the website of the relevant voivode’s office. There is also a fee for issuing or extending a work permit.

Documents required to be submitted by the employer
▪A completed application form
▪Evidence of payment of application fees
▪Confirmation of the legal status of the employer from the National Court Register
Current records of the employer’s economic activity
▪Copies of the applicant’s passport pages with relevant travel information
▪Evidence that the applicant has health insurance
▪A deed for the company
▪A copy of a statement regarding profits or losses of the employer
▪A copy of a contract in accordance with the service being provided by the business in Poland

Work permit takes at least 10 to 12 weeks.

There are many procedures to fulfill while applying for the work permit. And it all matters according to the application traffic in the particular regional office.
